On December 13, the National Labor Relations Board (NLRB) announced that it would be publishing a final rule reversing several of the Agency’s 2014 amendments to the representation case procedures. The Obama-era regulations were known as “ambush elections” rules that allowed for union representation elections to be held quickly and without ample time for employees to make informed decisions regarding union representation. The DOL’s modifications are intended to result in more efficient and fair election processes for all stakeholders.
The final rule is expected to be published on December 18th and will become effective on April 16, 2020.
