Federal Court Allows Staffing Firm to Sue Employer for Race Bias

On Jan. 15, a judge from the US Fifth Circuit Court of Appeals ruled in a case (White Glove Staffing, Inc. v. Methodist Hospitals of Dallas) that a staffing agency could sue an employer for race bias over the employer’s alleged preference for workers of a specific ethnicity expressed during contract negotiations. This ruling underlines an increasing trend of federal courts allowing corporations to make Section 1981 violations claims.
