EEOC Updates Guidance on COVID-19 Testing in the Workplace

U.S. Equal Employment Opportunity Commission (EEOC) published updated Technical Assistance Questions and Answers on April 23, related to an employer’s ability to conduct testing related to COVID-19. The guidance affirms that employers may lawfully administer COVID-19 testing on employees as part of a screening process before allowing employees into the workplace without running afoul of the Americans with Disabilities Act (ADA).
